21 male In a healthy relationship and expecting his first child. He lived the street life but wanted to slow for when his child was born. The only downfall was he never graduated high school nor held a job. Employers definitely were not knocking on his door. In need of money, he decided to pull one more job.
October 19, 2005 he was arrested for first degree murder. Later being convicted of first degree murder, attempted murder, assault with a dangerous weapon, and illegal possession of a fire arm. Now he feels the justice system owes him an appeal.
The trial lasted four days, the deliberation two hours. The district attorney presented a number of witnesses but three that sealed his fate. One man was the one the assailant was being charged attempted murder for, the other man was the one the assailant was being charged assault for, and the last was a woman who testified to being with the assailant the night of the murder though not at the time the crimes were committed.
Upon hearing a guilty verdict, the judge ordered the assailant life with no possibility of parole plus an extra 16 years.
The relationship went downhill and his girlfriend was going to be a single mom. Due to the stresses of the trial, they are now separated and nothing but dislike lingers between them.
Its been four years now and the assailant feels justice was not served, not that any convict does, but his rational is of the unreal. He feels he will be released without question for the following reasons
Reason 1: his attorney (who was a public defender) was an ex DA and very good friends with the one prosecuting the case.
Reason 2: he had an all white jury (yet he lived in a middle class county whose majority population was made up of white people and the law states you must have jury of your peers)
Reason 3: the prime suspects were granted immunity to testify against him
Reason 4: his attorney did not comply with his wishes and file motions that he had requested
His rational: the justice system is going to grant him an appeal, release him from prison in the next 2-3 years, and he is going to win a lawsuit for $2 million
Let’s gets real, the justice system is not that compliant. They do things on their time and at their discretion. You may never get an appeal. For one, you have to prove that your trial was faulty to get a new one. Secondly, let’s say you do get a new trial, it’s very possible that you could be found guilty all over again. As far as the justice system, don’t EVER hold your breath waiting for a payout from them. You have to prove without reasonable doubt that the police and DA knew you were innocent and continued to prosecute you and you were convicted as a result of it.
I’m sure life behind bars is not an easy one. Its good to have hope, but remember to be realistic so that you don’t let yourself down. And most important, always remember no government institute ever owes you anything. Not even when they really do.
